Dying without a will is otherwise known as dying intestate.

When a person dies intestate, , the “laws of the land” kicks in to administer and distribute the person’s estate.

In Nigeria, the particular law that will apply depends on a number of factors including where the person lived, the person’s lifestyle, what type of marriage the person had etc.

Taking all these into consideration, the deceased’s family will apply to the relevant court which could be the high court of a state, customary court or sharia court to appoint administrators over the deceased’s estate and these administrators will be the persons to determine how the deceased’s assets are administered and distributed.
